General Conditions of Contract – Diving on the Moon

These General Conditions regulate the contracting of services offered by Diving on the Moon – Matías Urso Freije, located at Paseo Aquilino Nº10, 1º piso, 38650 Los Cristianos (Tenerife). By booking and participating in our activities, clients expressly accept these terms.

1. Description of Services

Diving on the Moon offers recreational diving experiences and aquatic activities, including:

  • Sea Trek Experience

  • Scuba Diving

  • Guided Snorkeling

  • Rental of diving equipment

All activities are guided and supervised by accredited professional instructors.

2. Prices and Payment Methods

  • Prices indicated on the website are final, include applicable taxes (IGIC), and are shown in euros (€).

  • Payments may be made by credit/debit card, bank transfer, online payment platforms, or cash at the center.

  • To confirm the reservation, full payment or a deposit (as specified during the booking process) is required.

3. Booking and Reservation Process

  • Reservations may be made online through the website, by email, or in person at our facilities.

  • Clients will receive a booking confirmation by email, which serves as proof of reservation.

  • For a booking to be valid, clients must provide correct contact details.

  • For activities that require special preparation, Diving on the Moon may request additional information before confirming the reservation.

4. Cancellation and Refund Policy

  • If the client cancels more than 48 hours before the scheduled date, the full amount of the reservation will be refunded.

  • If cancellation is made less than 48 hours before the activity, no refund will be given.

  • In case of no-show on the day of the activity, the reservation will be considered forfeited with no refund.

  • If the activity cannot take place due to weather conditions, safety reasons, or by decision of Diving on the Moon, the client will be offered the choice of:

    • Rescheduling the activity for another available date, or

    • Receiving a full refund of the reservation.

  • Refunds will be processed using the same payment method used by the client.

5. Right of Withdrawal

In accordance with consumer regulations, the 14-day right of withdrawal does not apply to leisure services with a specific date or period of performance.
Therefore, once the booking is confirmed, only the cancellation policy outlined above will apply.

6. Responsibility and Insurance

Health and Participation Requirements

  • The Sea Trek activity is available for adults and children aged 8 years and older (minors must be accompanied by a responsible adult).

  • No prior diving or swimming experience is required.

  • Persons with serious health conditions that may be affected underwater are not permitted to participate, including:

    • Heart or respiratory diseases

    • Epilepsy

    • Recent surgeries

    • Pregnancy

  • Before the activity, each participant must complete and sign a health declaration confirming fitness to participate.

Certifications

  • No diving certification is required to take part in the Sea Trek experience.

  • All activities are always guided by accredited professional instructors.

Insurance
Diving on the Moon provides all participants with:

  • Civil liability insurance

  • Accident insurance covering each participant during the activity

7. Client Obligations

The client agrees to:

  • Arrive punctually at the scheduled time. Failure to appear may result in loss of the reservation.

  • Follow all instructions given by Diving on the Moon staff at all times.

  • Use the provided equipment correctly and carefully, as instructed.

  • Provide truthful information regarding their health in the required declaration.

  • Refrain from participating under the influence of alcohol, drugs, or medication that may impair physical or mental abilities.

8. Limitation of Liability

Diving on the Moon guarantees that all activities are carried out under strict safety standards and with qualified personnel. Nevertheless, aquatic activities inherently involve certain risks.

The company is not responsible for accidents, damages, or losses resulting from:

  • Failure to follow safety instructions given by instructors

  • Omission or falsification of information provided in the health declaration

  • Improper or negligent use of the provided equipment

  • Undeclared physical or medical conditions that may endanger the participant

The liability of Diving on the Moon is limited to the coverage provided under its civil liability and accident insurance policies, contracted in accordance with current regulations.

The client acknowledges and accepts that participation in the activity is at their own risk, assuming the inherent risks within the applicable legal framework.

9. Intellectual Property

All website content, including texts, photographs, videos, logos, and training materials, is the property of Diving on the Moon or its rightful owners.
Reproduction, distribution, or unauthorized use is prohibited without express prior written consent.

10. Applicable Law and Jurisdiction

These conditions are governed by Spanish law.
For any dispute arising from the interpretation or execution of these conditions, both parties expressly submit to the jurisdiction of the Courts and Tribunals of Santa Cruz de Tenerife, waiving any other jurisdiction.

11. Available Languages

Pre-contractual information, these General Conditions, and the Cancellation Policy of Diving on the Moon will be available in Spanish and English.
In the event of discrepancies between versions, the Spanish text shall prevail.
